Please read these Terms of Use (the “Terms”) carefully, as they govern your access to and use of the TeamStreaks website, the TeamStreaks platform, its applications, interfaces, dashboards, features, content, notifications, and related services (collectively, the “Services”).
The Services are provided by TeamStreaks Inc., a corporation incorporated under the laws of Canada, with its registered office located at 855 Dunlop Avenue, Montréal, Québec H2V 2W6, Canada (“TeamStreaks”, “we”, “us”, or “our”).
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.
TeamStreaks is a digital employee engagement platform that enables organizations to create, manage, and monitor engagement experiences such as individual or team challenges, competitions, quizzes, polls, field activities, events, wellness initiatives, safety programs, ESG and corporate social responsibility (CSR) initiatives, volunteer activities, and team-building experiences.
The Services may be accessed by website visitors, individual users, employees, contractors, managers, administrators, or representatives of a customer organization that has entered into an agreement with TeamStreaks (the “Business Account Holder”).
When an organization uses the platform, TeamStreaks acts as the technology provider and intermediary between the user and the Business Account Holder. The Business Account Holder remains solely responsible for organizing its internal initiatives, selecting participants, establishing the rules applicable to activities, and determining how the resulting information is used within its organization.
TeamStreaks may modify these Terms at any time to reflect changes to the Services, applicable laws, or our business practices.
Where changes are material, TeamStreaks will use reasonable efforts to notify users or Business Account Holders. Unless otherwise required by applicable law, such changes will become effective thirty (30) days after notice is provided or the updated Terms are published through the Services. Your continued use of the Services after the effective date of such changes constitutes your acceptance of the revised Terms.
Certain features require the creation of a user account. When creating an account, you agree to provide accurate, complete, and up-to-date information.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify TeamStreaks promptly of any unauthorized use of your account or any suspected security breach.
Access to the platform may be granted by a customer organization. In such cases, your access may be suspended or terminated if you are no longer authorized by that organization, if your relationship with the organization ends, or if the agreement between the organization and TeamStreaks is terminated.
Subject to your compliance with these Terms, TeamStreaks grants you a limited, non-exclusive, non-transferable, and revocable right to access and use the Services solely for the purposes intended by TeamStreaks or the applicable Business Account Holder.

TeamStreaks may enhance, add, modify, or discontinue certain features at any time, subject to its contractual commitments with Business Account Holders.
The activities offered through TeamStreaks are designed to encourage engagement, participation, collaboration, awareness, and collective involvement.
Unless otherwise specified by the Business Account Holder, participation in challenges, activities, or experiences is voluntary. Users remain solely responsible for their decisions, their level of participation, and for respecting their own personal limits.
The Services do not provide medical, professional, legal, psychological, or healthcare advice. Any physical, wellness, or safety-related activity should be undertaken with appropriate caution and in accordance with applicable instructions, the user’s health condition, and the policies and requirements of the organization.
Where the platform allows users to publish messages, comments, photos, responses, content, or engage in social interactions, you remain solely responsible for any content you submit or publish.
You agree not to publish content that is:
TeamStreaks and, where applicable, the Business Account Holder, may moderate, hide, remove, or report any content that violates these Terms, applicable laws, or the organization’s internal policies.
Any opinions, content, or interactions published by users are solely those of their respective authors.
The collection, use, retention, and disclosure of personal information in connection with the Services are governed by the TeamStreaks Privacy Policy, which forms an integral part of these Terms.
TeamStreaks is committed to processing personal information in accordance with applicable privacy laws, including Quebec’s Law 25, Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), and, where applicable, the European Union General Data Protection Regulation (GDPR).
Depending on the configuration of the Services and the agreed settings, the Business Account Holder may have access to certain data relating to participation, results, teams, or activities. Data made available to customer organizations may be individual, aggregated, or anonymized, depending on the features used and applicable legal requirements.
TeamStreaks may collect, generate, and use aggregated, anonymized, or statistical data relating to the use of the Services for the purposes of measuring platform performance, improving functionality, developing new services, producing analytics, and enhancing the user experience.
Such aggregated data does not directly identify any individual user. Unless otherwise required by law or agreed with the applicable Business Account Holder, TeamStreaks retains all rights in and to aggregated data derived from the use of the Services.
Certain TeamStreaks features may use artificial intelligence (“AI”) to assist in generating content, recommending activities, personalizing experiences based on user preferences, or identifying engagement trends.
Content generated, suggested, or personalized by AI is provided for assistance purposes only and may not always be accurate, complete, appropriate, or error-free. TeamStreaks does not warrant the accuracy, relevance, or suitability of AI-generated content in every context.
Where AI-generated content is intended to be published, widely distributed, or used in sensitive contexts, administrators or authorized users are encouraged to review such content before use.
Users and Business Account Holders remain solely responsible for their use of AI-generated or AI-personalized content, including ensuring its compliance with applicable laws, internal policies, and organizational objectives.
The Services, platform, software, interfaces, logos, trademarks, text, graphics, content, databases, features, source code, templates, algorithms, and all other elements of TeamStreaks are protected by applicable intellectual property laws and remain the exclusive property of TeamStreaks or its licensors.
No ownership rights are transferred to you under these Terms. These Terms grant only a limited right to access and use the Services.
You may not use TeamStreaks’ trademarks, logos, trade names, or other distinctive branding without our prior written consent.
Users and Business Account Holders retain ownership of the content, information, text, images, logos, graphics, and documents they submit to TeamStreaks.
By uploading or publishing content through the platform, you grant TeamStreaks a limited, non-exclusive, worldwide license to host, reproduce, display, process, and use such content solely to the extent necessary to provide, secure, maintain, improve, and operate the Services.
You represent and warrant that you have all necessary rights to the content you provide and that such content does not infringe the rights of any third party.
The Services may integrate with or allow the use of third-party services, software, platforms, or providers, including authentication, hosting, payment processing, analytics, messaging services, Microsoft Teams, and other business tools.
Your use of such third-party services may be subject to their own terms of service and privacy policies. TeamStreaks is not responsible for third-party services that are not under its direct control.
TeamStreaks uses commercially reasonable efforts to maintain the availability, security, and reliability of the Services.
However, the Services may be temporarily unavailable due to maintenance, updates, technical incidents, cyberattacks, network failures, force majeure events, or circumstances beyond TeamStreaks’ reasonable control.
TeamStreaks may suspend access to all or part of the Services whenever reasonably necessary to protect the platform, its users, data, systems, or to prevent unauthorized or improper use.
To the fullest extent permitted by applicable law, the Services are provided “AS IS” and “AS AVAILABLE”, without any express or implied warranties, including warranties of uninterrupted operation, error-free performance, fitness for a particular purpose, continuous availability, or the achievement of any particular engagement, participation, or organizational outcomes.
TeamStreaks does not warrant that use of the Services will result in any specific level of participation, engagement, satisfaction, performance, behavioral change, or organizational results.
Subject to any mandatory provisions of applicable law and to the fullest extent permitted by law, TeamStreaks and its directors, officers, employees, representatives, suppliers, and partners shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or relating to the use of, or inability to use, the Services.
Without limiting the foregoing, TeamStreaks shall not be liable for:
TeamStreaks' total aggregate liability arising out of or relating to these Terms or the use of the Services shall not exceed the total amount of fees actually paid to TeamStreaks by the Business Account Holder during the twelve (12) months immediately preceding the event giving rise to the claim or, if no fees have been paid for the use of the Services, one hundred Canadian dollars (CAD $100).
You agree to indemnify, defend, and hold harmless TeamStreaks, its directors, officers, employees, representatives, suppliers, and partners from and against any claims, losses, liabilities, damages, costs, and reasonable expenses arising out of or relating to your misuse of the Services, your breach of these Terms, any content you publish through the platform, or your infringement of the rights of any third party.
You may request the deletion of your account through the platform or by contacting TeamStreaks using the contact information provided below.
TeamStreaks may suspend or terminate an account in the event of a violation of these Terms, prolonged inactivity, a request from the Business Account Holder, or where continued access is no longer necessary for the provision of the Services.
Deleting an account may result in the deletion or anonymization of associated data, subject to applicable legal retention requirements, technical backup procedures, and the rights of the applicable Business Account Holder.
The provisions relating, including but not limited to, intellectual property, aggregated data, limitation of liability, indemnification, governing law, and any other provision which, by its nature, is intended to survive the termination or expiration of these Terms, shall remain in full force and effect following the termination of these Terms, the deletion of an account, or the discontinuation of the use of the Services.
By using the Services, you agree to receive communications necessary for the operation of the platform, including notifications relating to your account, activities, challenges, results, updates, or security.
Marketing or promotional communications will be sent in accordance with applicable laws and any required consents. You may unsubscribe from marketing communications at any time.
The Services may contain links to third-party websites, services, or content. TeamStreaks does not control such third-party resources and is not responsible for their content, availability, security, or privacy practices.
TeamStreaks shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control, including, without limitation, natural disasters, major system failures, cyberattacks, network outages, war, riots, pandemics, strikes, governmental actions, or the failure of essential third-party service providers.
These Terms shall be governed by and construed in accordance with the laws of the Province of Québec and the applicable federal laws of Canada.
Subject to any mandatory provisions of applicable law, any dispute arising out of or relating to these Terms or the use of the Services shall be submitted to the competent courts of the Province of Québec, Judicial District of Montréal.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
The failure of TeamStreaks to exercise any right or to enforce any provision of these Terms shall not constitute a waiver of such right or provision.
These Terms, together with the Privacy Policy and any applicable agreement between TeamStreaks and the Business Account Holder, constitute the entire agreement governing your use of the Services.
TeamStreaks may assign or transfer these Terms in connection with a merger, acquisition, reorganization, or the sale of all or part of its business or assets. You may not assign or transfer any of your rights or obligations under these Terms without TeamStreaks' prior written consent.
